Terms of Service
These Terms of Service (“Terms”) govern your use of the MedScanX mobile application and the website at medscanx.1dot.ai (together, the “Service”). By downloading, accessing, or using MedScanX, you agree to these Terms. If you do not agree, do not use the Service.
1. Not medical advice
MedScanX provides general informational reference about medicine package labels and publicly available labeling data. It is not medical advice, diagnosis, treatment, dosing instruction, or a substitute for professional care. Label data can be incomplete, outdated, mismatched, or wrong. Always verify with a pharmacist, clinician, or the physical product labeling. In an emergency, contact local emergency services. MedScanX is not a medical device and is not FDA-approved as a diagnostic or therapeutic tool.
2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use MedScanX on Apple-branded devices you own or control, as permitted by the App Store Terms of Use. You may not copy, modify, distribute, reverse engineer (except to the extent permitted by law), rent, or sublicense the app.
3. Apple App Store terms
If you obtained MedScanX from the Apple App Store, you acknowledge that these Terms are between you and the MedScanX publisher, not Apple. Apple has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation for the app. Apple is not responsible for addressing claims relating to the app or your possession/use of it, including product liability, legal/regulatory failure, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
4. Freemium and MedScanX Pro
- New installs may include a limited number of free MatchCards (currently two successful MatchCards). Limits and features may change.
- MedScanX Pro (or similarly named unlock) may be offered via in-app purchase through Apple. Pricing, duration, and renewal are shown in the App Store / purchase sheet at the time of buy.
- Manage or cancel subscriptions in your Apple ID settings. Refunds are handled by Apple under Apple’s policies unless applicable law requires otherwise.
- We may change free allowances or Pro benefits with reasonable notice in the app or listing.
5. Acceptable use
You agree not to:
- Use the Service for unlawful purposes
- Attempt to disrupt, overload, or reverse engineer our APIs or systems
- Misrepresent MatchCard results as clinical advice or FDA endorsement of the app
- Scrape or republish label content in violation of third-party terms or law
- Upload content you do not have rights to process
6. Third-party data and services
Match results may rely on public sources such as openFDA / DailyMed and optional cloud vision providers. Those sources are not under our exclusive control. We do not warrant that any third-party data is accurate, complete, or current. Attribution to a source does not imply partnership or endorsement.
7. Privacy
Our collection and use of information is described in the Privacy Policy, which is incorporated by reference.
8. Intellectual property
MedScanX name, icon, MatchCard presentation, and original app content are owned by the publisher or its licensors. Public label text and trademarks of drug manufacturers remain their owners’. You receive no rights in those marks except as needed for personal, informational use of the Service.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MATCHES WILL BE CORRECT, THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT LABEL DATA WILL MEET YOUR REQUIREMENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR MEDSCANX PRO IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations; in those places, liability is limited to the fullest extent permitted.
11. Indemnity
You agree to defend and indemnify the publisher against claims arising from your misuse of the Service, your violation of these Terms, or your reliance on MatchCard or label information contrary to the “not medical advice” disclaimer.
12. Termination
You may stop using MedScanX at any time by deleting the app. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Sections that by nature should survive (including disclaimers, liability limits, and indemnity) will survive termination.
13. Changes
We may update these Terms by posting a revised version on this page with a new effective date. Continued use after changes constitutes acceptance. If you do not agree, discontinue use and delete the app.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which the publisher is established, excluding conflict-of-law rules, unless mandatory consumer protections in your country of residence apply. Courts in that jurisdiction will have exclusive venue, subject to applicable consumer rights.
